Terms of Service

These terms govern the use of ServEase hospital management software. By using ServEase, a hospital and its staff agree to them.

ServEase is administrative software, not a medical device. It records and organises information that clinicians and hospital staff enter. It does not diagnose, does not recommend treatment, and does not make clinical decisions. Every clinical judgement remains the responsibility of the treating clinician.

Who these terms are with

Our agreement is with the hospital, which decides what information is collected and why. Patients interact with ServEase through their hospital, and their information is handled as described in our Privacy Policy.

What we provide

Features change as the product develops. We will not remove something a hospital actively depends on without telling them first.

What the hospital is responsible for

Whose data it is

Patient records belong to the hospital. We hold them to provide the service and do not sell them, share them with other hospitals, or use them for advertising.

On request, or when the agreement ends, we will return the hospital's data in a usable format. We may keep aggregated, de-identified information that cannot be traced to any individual — for example, how long queues typically run — to improve the product.

ServEase itself, including its software and design, remains ours.

Availability

We aim to keep ServEase available at all times but do not guarantee uninterrupted service. Maintenance, updates and failures in services we depend on — including WhatsApp, hosting and payment providers — can interrupt it.

ServEase must not be the only record of anything a hospital cannot afford to lose. A hospital should retain its own records as required by law regardless of what our system holds.

Fees

Fees are as agreed with each hospital. Invoices are payable as stated on them. We will give reasonable notice before changing fees, and a hospital that does not accept a change may end the agreement.

Ending the agreement

Either side may end this agreement with 30 days' written notice. We may suspend access immediately if the service is being used unlawfully or in a way that endangers patient data.

After the agreement ends, we will return or delete the hospital's data within 90 days, except where the law requires us to keep something.

Limits of our responsibility

ServEase is provided as it is. We do not accept responsibility for clinical decisions, for information entered incorrectly, or for losses arising from the hospital's own systems or processes.

Where liability cannot be excluded by law, it is limited to the fees paid to us in the twelve months before the claim arose.

Nothing here limits liability for fraud, or for anything that cannot lawfully be limited.

Changes to these terms

If these terms change materially, we will notify the hospitals using ServEase before the change takes effect.

Governing law

These terms are governed by the laws of India, and the courts of Udham Singh Nagar, Uttarakhand have jurisdiction.
